How to buy property in Turkey

In Turkey buying a property for foreigners is much easier than in other European countries. You can purchase properties in your own name if there is mutuality between Turkey and your country.

Foreigners are not allowed to buy properties under the conditions below

  • If the region is within a military zone
  • If the region is not under management of a municipality (this law has changed recently , so foreigners are allowed to buy properties in villages also)
  • If the buyer has a serious criminal record
  • If there is no mutuality between Turkey and your country
  • Decision of the Council of Ministers is required for buying a property bigger than 30 hectares.

The demands of citizens of countries that are not involved in the lists above , will be confirmed by consulting the General Directorate.

An application needs to be submitted to the Local Land Registry Office. After completion of all necessary searches and checks, the title will be transferred to the name of new owner.

Both, buyer and seller must go to the land registry office and sign in person. It's possible for purchaser or seller to give power of attorney to a third party whom they trust (this needs notorization) so all necessary paperwork can be completed and documents can be signed, even if the purchaser is not in Turkey . This is the most common way that is used by foreigners.

TAXES

There is a purchase tax for both buyer and seller. This is levied at 3% of the declared value of the property on the title deed. This tax payment is made at the time of deed transfer.

The property owners have to pay annual taxes to the municipality which costs 0.3 %. All properties are subject to re-evaluation every year for tax purposes by municipalities.

Properties may be sold or rented out and proceeds may be transferred out of Turkey.
